If you have defaulted or had a court judgment against you, a judgment creditor will get a wage garnishment against you. This is relatively quick and cheap. When this happens your options are:
- Quitting your job;
- Claiming that your pay is below the poverty line;
- Claiming other wage garnishments are already in effect;
- Settling the judgment with a payment plan; or,
- Filing for bankruptcy
The best defense to protect wages is to file bankruptcy and get your money back from the sheriff. The court will “split the baby” if you claim poverty and give your judgment creditor some of your pay–or, if the court senses you are stalling, completely deny the claim.
The IRS is even more efficient if you owe back taxes. The poverty level is so low that you will be eating nothing but beans until the tax bill and penalties are fully paid.
